Since the Real Estate Valuation Ordinance (ImmoWertV) came into force in the version dated July 14, 2021, the valuation of real estate in Germany has been regulated in much more detail than before. § 194 BauGB defines the market value as the price that would be achieved in normal business transactions based on the legal circumstances and actual characteristics. A real estate expert provides exactly this proof, often in the event of a dispute, in inheritance disputes, in a foreclosure auction or before the tax office. The supervision of publicly appointed and sworn experts lies with the Chambers of Commerce and Industry in accordance with Section 36 GewO.

What a real estate appraiser does

A real estate expert creates reports that clearly document the market value, the mortgage lending value, the structural damage or the rental value of a property. The work begins with the clarification of the order and ends with a written report that must pass before the courts, banks, tax offices or supervisory authorities.

The typical occasions are inheritance disputes, divorces, compulsory auctions, purchase price determinations, tax valuations according to Section 198 BewG or balance sheet estimates according to IAS 40. In each of these cases, a third party checks the report carefully so that the methodology, the database and the conclusions are seamless must be documented.

Methodologically, the expert works according to the three standardised procedures of the ImmoWertV: comparative value method, income value method and material value method. Which procedure is used depends on the valuation object and the reason for the valuation. Owner-occupied single-family homes are usually valued using the material value method, rental houses using the income value method.

Publicly appointed, certified, independent expert

The German market knows three types of experts, whose status designations are precisely regulated by law. Section 36 GewO regulates the public appointment and swearing in by the Chamber of Commerce and Industry, the Chamber of Architects or the Chamber of Agriculture. This appointment requires special expertise, personal suitability and a passed examination.

A publicly appointed expert bears the official seal of the appointing body and is obliged, according to Section 407a ZPO, to give priority to accepting expert reports from the courts. His reports enjoy particular evidentiary value in court because the appointment process itself represents quality assurance by the chamber.

Certified experts according to DIN EN ISO/IEC 17024 are examined by accredited certification bodies, such as HypZert, DIA or Sprengnetter. The certificates are issued for a limited period and are periodically recertified. Banks generally accept HypZert-certified experts in commercial real estate financing because MaRisk sets minimum requirements for valuation quality.

Independent experts work without a public appointment or certification. They are allowed to prepare private reports, but are not obliged to take on court orders and do not enjoy any special evidentiary value in court. This variant is sufficient for many private sector orders, especially for pre-purchase evaluations.

Market value reports: the three standardised procedures

The ImmoWertV in the version dated July 14, 2021 standardises three valuation procedures that are binding for market value reports in Germany. The comparative value method according to Sections 24 to 26 ImmoWertV uses purchase prices of comparable properties from the purchase price collection of the appraisal committees. It is particularly suitable for condominiums, undeveloped land and standardised terraced houses because there is sufficient comparative data.

The income value method according to Sections 27 to 34 ImmoWertV evaluates the sustainable income achievable from a property. It is the standard procedure for apartment buildings, office buildings, retail properties and leased commercial properties. The central adjusting screw is the property interest rate, which is derived from the annual market reports of the appraisal committees.

The material value method according to Sections 35 to 39 ImmoWertV determines the value from the land value and the material value of the building. It is used when there are neither sufficient comparable properties nor reliable yield data, i.e. typically for owner-occupied single-family homes and special properties. The normal production costs 2010 (NHK 2010) form the basis for the calculation and are updated with the current construction price index.

In practice, the expert often combines several methods to check the plausibility of the results. A one-procedure valuation is considered vulnerable in the event of a dispute because it does not reflect the range of market assessments. The choice of method must be justified in the report.

The BMI's ImmoWertV application instructions from May 20, 2022 specify the application in detail and are used in every regular valuation. The expert documents the data sources, the property interest rates and the comparable objects with date, source and plausibility check.

Costs and JVEG table: what you plan for in 2026

The fees for expert reports in real estate matters either follow the Judicial Remuneration and Compensation Act (JVEG) in court-ordered proceedings or freely agreed on private orders. In its Appendix 1, the JVEG provides for different fee groups, ranging from 70 to 165 euros per hour. Experts in the real estate sector are generally assigned to fee groups 6 to 11.

In private orders, the fees are freely agreed. Realistic price ranges for 2026 are as follows: A short report for a condominium costs between 600 and 1,200 euros net. A complete market value report for a single-family home is between 1,800 and 3,800 euros net, depending on the files and the density of comparative data.

A market value report for an apartment building with an evaluated rental account, maintenance provisions and market analysis is between 4,500 and 8,500 euros net. Special reports for commercial properties, hotels or special objects go beyond this. Anyone who needs appraisals in large numbers, for example for a portfolio, typically negotiates flat rates per property.

The cost structure is based on three drivers: the procurement effort for the files (land register, building files, rental agreements), the effort for the on-site inspection with measurements and documentation, and the depth of the market analysis with comparable properties or income derivation. Tax aspects according to § 198 BewG or balance sheet estimates according to IAS 40 increase the effort considerably.

Anyone who obtains comparative offers should ask about the on-site inspection included, the number of comparable properties evaluated and the delivery time. Providers without on-site visits sell estimates, not reports.

The public appointment and swearing-in according to Section 36 GewO is a formal procedure that is carried out by the respective Chamber of Industry and Commerce or the Chamber of Architects. The prerequisite is special expertise, which is regularly proven by a relevant degree, at least five years of professional experience and a passed expertise test.

The expertise test typically includes a written part with assessment tasks, an oral part with a technical discussion and the presentation of sample reports from previous professional activity. The examination requirements are detailed in the chambers' respective appointment regulations. Personal suitability requires orderly economic circumstances, an impeccable certificate of good conduct and the willingness to take on court assignments. The appointment is for five years and can be extended upon request, provided that the expertise is proven through regular training.

The swearing-in obliges you to carry out your tasks impartially, independently and conscientiously. Anyone who violates this risks having their order revoked and, if necessary, criminal prosecution for false reports in accordance with Sections 153 and 154 of the Criminal Code. Supervision by the chamber is not a theoretical construct.

The reporting obligations to the appointing chamber include annual activity reports, the notification of significant changes in personal circumstances and the submission of evidence of further training. Anyone who does not document this properly will find themselves in trouble when it comes to renewal.

Specializations: HypZert, structural damage, ESG real estate

Within the world of experts, there are several specializations whose economic importance must be weighted differently in 2026. HypZert-certified experts value properties on behalf of banks and insurance companies for lending and market value purposes. HypZert GmbH is a subsidiary of the Association of German Pfandbrief Banks and is accredited according to DIN EN ISO/IEC 17024.

According to MaRisk (minimum requirements for risk management), banks are obliged to have assessments carried out by qualified experts. For residential real estate loans above the small loan limit of 400,000 euros in accordance with Section 24 of the Pfandbrief Act, a certified expert is regularly required.

Construction damage experts evaluate defects in buildings, moisture damage, static problems or deficiencies in the construction work. The assessment is usually used as evidence in court or for arbitration between the builder and the executing company. The VOB/B and the BGB work contract law form the legal basis.

ESG experts will be a growing specialist field in 2026 because the EU taxonomy and the CSRD tighten the reporting requirements for real estate portfolios. The ESG assessment of existing properties includes energy efficiency, carbon pathways, climate risks (physical and transitory) and social indicators. The EU action plan to finance sustainable growth is driving demand.

Anyone who commissions an ESG assessment should pay attention to the application of recognised standards, such as ECORE, EPRA sBPR or GRESB. These standards are neither legally binding nor identical, but cover different reporting purposes. Experts are liable for their reports in accordance with Section 839a of the German Civil Code in the event of incorrect reports prepared intentionally or through gross negligence. The range of possible damage is considerable and can reach seven-figure amounts for commercial properties.

Professional liability insurance with sufficient coverage is therefore mandatory. The sum insured depends on the typical order structure and for experts in the residential real estate sector is between 1 and 3 million euros per claim. In the commercial real estate segment, coverage amounts starting from 5 million euros are recommended, and in individual cases significantly higher.

The evidence in the report must support each conclusion with data sources, calculations and justifications. The four-eye principle is standard practice in the industry, i.e. the calculations are checked by a second qualified person before the report is sent. The DIN ISO 9001 certification of the expert office increases acceptance among large clients.

The retention period for reports is ten years according to Section 257 of the German Commercial Code (HGB), and also ten years in the tax context according to Section 147 of the AO. Anyone who archives a market value report should also store the digital raw data, the comparison object evaluation and the market research in an audit-proof manner in order to be able to answer later questions.

In the event of a dispute in court, the court of fact checks the plausibility of the report, questions the expert orally and can request additional explanations. Anyone who uses this confidently protects the mandate and their own reputation.

Digital assessment, AI models and their limitations

Automated valuation models (AVM) and AI-supported valuation tools will be an integral part of the real estate industry in 2026. Banks use them for preliminary checks in the mass lending business, broker portals for price assessments, and platform providers for quick initial indication. The models are based on large amounts of data from purchase price collections, advertisements and geodata.

However, AVMs are not sufficient for court-approved reports and for loan-to-value values ​​above the small loan limit. MaRisk and the Lending Value Ordinance (BelWertV) require an individual assessment by a qualified expert. Section 16 BelWertV describes the requirements for valuation in detail.

The EU AI Act, which has been in force since August 1, 2024 and establishes staggered obligations, classifies credit rating systems as high-risk AI according to Annex III. Banks and insurance companies using AVM must demonstrate risk management, data quality, documentation and human oversight.

Human oversight of AVM results often falls to the expert. Anyone who accepts an AVM result without checking the methodology risks liability for incorrect valuation assumptions. In its 2025 market reports, the Federal Institute for Building, Urban and Spatial Research (BBSR) put the hit accuracy of the common AVM tools at ±15 percent for standard properties, with a significantly greater spread for special properties.
