What is a Hazardous Substances Officer in Germany?
A hazardous substances officer in Germany, called Gefahrstoffbeauftragter or GSB, is the qualified expert responsible for the safe handling of hazardous chemicals across procurement, storage, use and disposal. The role is rooted in the Gefahrstoffverordnung (GefStoffV): § 6 on risk assessment, § 7 on the basic obligations including the priority of substitution in § 7 Abs. 3, § 8 and § 9 on general and additional protective measures, § 14 on operating manuals and instruction. Under § 6 Abs. 11 GefStoffV only qualified persons may carry out the risk assessment.
The accepted technical rules supply the method: TRGS 400 for substance-related risk assessment, TRGS 510 for storage, TRGS 555 for operating manuals, TRGS 900 for workplace limit values. The hazardous substances register, called Gefahrstoffverzeichnis, is mandatory under § 6 Abs. 12 GefStoffV and lists the substance name, its classification, the quantity ranges in use, the working areas concerned and a reference to the safety data sheet. The explosion-protection document under § 6 Abs. 9 GefStoffV, with TRGS 720 to 727, is added wherever hazardous explosive atmospheres can occur. At EU level, REACH Regulation 1907/2006 governs registration, authorisation and restriction, CLP Regulation 1272/2008 classification and labelling.
In practice the role is a standing task rather than a project. It starts with an inventory of the substances actually in use, a reconciliation of safety data sheets against real consumption, and the workstation-level risk assessment. From then on the officer keeps that picture current: § 6 Abs. 10 GefStoffV requires the assessment to be reviewed regularly and updated immediately once material changes or new information call for it. Documentation follows § 6 Abs. 8 GefStoffV, and instruction under § 14 Abs. 2 GefStoffV runs annually against a signed attendance record.
In an inspection by the Gewerbeaufsicht (trade supervisory authority) or the Berufsgenossenschaft (statutory accident insurer), what fails is rarely the binder but the break in the chain of evidence: a register that does not know the drum standing in the store, or a substitution check under § 6 Abs. 1 Satz 2 Nr. 4 GefStoffV recorded as one sentence instead of a documented weighing of alternatives. Under § 19 Abs. 4 GefStoffV the authority may demand proof that a qualified person prepared the assessment. Breaches listed in § 22 Abs. 1 GefStoffV are administrative offences under § 26 Abs. 1 Nr. 8 Buchst. b ChemG, fined up to 50,000 euros.
Duties of the Hazardous Substances Officer
- Maintain the hazardous substances register under § 6 Abs. 12 GefStoffV with substance name, classification, quantity ranges in use, working areas and a reference to the safety data sheet.
- Perform the substance-related risk assessment under § 6 GefStoffV using the TRGS 400 methodology, as a qualified person under § 6 Abs. 11 GefStoffV.
- Run the substitution check under § 6 Abs. 1 Satz 2 Nr. 4 GefStoffV, substitute as a priority under § 7 Abs. 3 GefStoffV and justify any waiver under § 6 Abs. 8 Nr. 3 GefStoffV.
- Compile and update the explosion-protection document (Ex-Schutz-Dokument) under § 6 Abs. 9 GefStoffV and TRGS 720 to 727.
- Coordinate the safety data sheet management under Art. 31 REACH and verify CLP classification.
- Maintain operating manuals under § 14 Abs. 1 GefStoffV in a form and language the workforce actually understands, and run annual instruction under § 14 Abs. 2 GefStoffV with documented signature.
- Run the storage compliance under TRGS 510 including mixed-storage rules, ventilation and fire protection.
- Coordinate workplace measurements against TRGS 900 limit values and the BioStoffV for biological agents where overlapping.
- Track REACH authorisation deadlines and sunset dates for Annex XIV substances.
- Liaise with the trade supervisory authority, the Berufsgenossenschaft and the local fire authority on incidents and inspections.
When must a Hazardous Substances Officer be appointed?
Unlike the data protection officer or the SiFa, the Gefahrstoffbeauftragter is not appointed by a single statutory provision in the GefStoffV. The duty arises indirectly. § 6 Abs. 11 Satz 1 GefStoffV allows the risk assessment to be carried out only by qualified persons, called fachkundige Personen, and Satz 2 obliges an employer who lacks that knowledge to take qualified advice. § 2 Abs. 16 GefStoffV defines Fachkunde as the specialist knowledge the specific task requires, resting on relevant vocational training, professional experience or recently exercised comparable work, plus attendance at specific refresher measures. Under § 19 Abs. 4 GefStoffV the competent authority may demand proof that the assessment was prepared in line with § 6 Abs. 11 GefStoffV. In practice this function is operationalised as the Gefahrstoffbeauftragter. Where carcinogenic, mutagenic or reproductive-toxic substances of category 1A or 1B are handled, the special measures of § 10 GefStoffV apply on top; asbestos work follows §§ 11 and 11a GefStoffV. Where the entity is also caught by the Störfall-Verordnung 12. BImSchV at lower or upper tier, a separate safety manager must be designated. TRGS 510 sets no appointment threshold: its quantity thresholds trigger additional storage, segregation and fire-protection measures. External Gefahrstoffbeauftragter engagements at hourly rates of 130 to 220 euros are the typical mid-market solution.
- Activities involving carcinogenic, mutagenic or reproductive-toxic substances of category 1A or 1B, with the minimisation duty of § 10 GefStoffV.
- Storage of category 1 or 2 flammable liquids (H224, H225) above 200 kilogrammes, triggering the additional measures in Table 1 of TRGS 510.
- Hazardous explosive atmospheres requiring an explosion-protection document under § 6 Abs. 9 GefStoffV with TRGS 720 to 727.
- Establishments within the lower or upper tier of the 12. BImSchV, which need a separate safety manager as well.
- REACH duties of the company: registration under Art. 6 Regulation 1907/2006, or authorisation for Annex XIV substances under Art. 56 REACH.
- Workplace measurement exceedance of TRGS 900 limit values requiring documented remediation.
