What is a Fire Protection Officer in Germany?

An external fire protection officer Germany, called Brandschutzbeauftragter or BSB, is the person responsible for operational fire protection inside a company or facility. The role is not regulated by a single federal statute but by a combination of state building law, the workplace ordinance and accident insurance norms. DGUV Information 205-003 defines the appointment criteria, qualification and tasks; DGUV Information 205-023 sets the training standard of 64 lecture units plus a final exam and recurring refresher training every three years; ASR A2.2 of the Technical Rules for Workplaces, last revised in 2022, requires the appointment in workplaces with elevated fire risk; DIN 14096 defines the fire protection ordinance, called Brandschutzordnung, in parts A for everyone, B for occupants and C for persons with specific duties. The fire protection concept that the BSB maintains follows the Musterbauordnung and the relevant Landesbauordnung, in particular § 14 MBO on basic fire protection requirements, and structures preventive measures in five areas: structural, technical, organisational, defensive and personal protection. Sanctions follow state administrative fine catalogues with typical penalties of 500 to 50,000 euros under § 84 MBO equivalents, plus § 145 OWiG for misuse of safety equipment and § 319 StGB for endangering construction safety. Insurance carriers can refuse or reduce indemnity under § 81 VVG where required fire protection measures are missing.

Duties of the Fire Protection Officer

  • Maintain and update the fire protection ordinance, called Brandschutzordnung, under DIN 14096 parts A, B and C.
  • Operate the fire protection concept under § 14 of the relevant Landesbauordnung and coordinate with the fire authority.
  • Train fire safety helpers, Brandschutzhelfer, with at least 5 percent of the workforce under ASR A2.2 section 7.3.
  • Conduct annual fire drills and document them with photographic evidence and a debrief report.
  • Inspect escape and rescue routes, signage and emergency lighting under ASR A1.3 and ASR A3.4 quarterly.
  • Check fire extinguishers under DIN 14406-4 every two years and document the inspection seal.
  • Investigate every fire, near miss or false alarm with a documented root cause analysis.
  • Advise the executive management on changes to occupancy, building works and storage configurations.
  • Coordinate with the local fire authority, structural fire protection consultants and insurance carriers.

When must a Fire Protection Officer be appointed?

The duty to appoint a fire protection officer follows mainly from special construction law and from accident insurance norms, not from a single federal statute. Most Landesbauordnungen require a Brandschutzbeauftragter for special-purpose buildings under § 51 MBO equivalents, in particular for industrial buildings under the Muster-Industriebau-Richtlinie of 2019, for high-rise buildings, hospitals, hotels, schools and shopping centres. Where building permits include the appointment as a condition, the Brandschutzbeauftragter becomes part of the operating permit. ASR A2.2 section 7.4 demands the appointment in workplaces with elevated fire risk, irrespective of building category. The DGUV Information 205-003 expects appointment in companies with more than 100 employees, in production with fire-relevant processes such as welding or solvent use, and in buildings exceeding 5,000 square metres of usable area. Qualification under DGUV Information 205-023 requires a 64-lecture-unit training plus an exam at an accredited institute. External engagements at hourly rates of 120 to 220 euros net are the typical mid-market solution and meet the independence requirements expected by the fire authority and insurance carriers.
