§ 17 BFSG: whoever relies on disproportionate burden documents it, keeps it for five years, reassesses on every change and notifies without delay

The exemption in § 17 of the German Accessibility Act (BFSG) is not a free pass. Subsection 2 requires a documented assessment kept for five years, subsection 3 a repeat at least every five years and on every change to the service, subsection 5 immediate notification of the market surveillance authority. Only micro-enterprises are partly exempt, and those end at ten employees.

An exemption made of five duties

Since 28 June 2025 the Barrierefreiheitsstärkungsgesetz has applied to the products and consumer services listed in § 1(2) and (3) BFSG. Who is covered and what the accessibility statement under Annex 3 must contain is described elsewhere. This article deals with the one provision that proposals and slide decks regularly present as the way out: § 17 BFSG, disproportionate burden. Anyone who reads the text finds not a way out but a procedure with its own documentation, repetition and notification duties.

This article reproduces § 17, § 2 no. 17, § 3(3) and Annex 4 BFSG as made available by gesetze-im-internet.de on 17 September 2026.

Subsection 1: the limit and who draws it

§ 17(1) BFSG reads: „Die Barrierefreiheitsanforderungen der nach § 3 Absatz 2 zu erlassenden Rechtsverordnung gelten nur insoweit, als deren Einhaltung nicht zu einer unverhältnismäßigen Belastung nach Anlage 4 des betreffenden Wirtschaftsakteurs führen würde. Der Wirtschaftsakteur nimmt eine entsprechende Beurteilung vor.“ – the accessibility requirements of the ordinance under § 3(2) apply only in so far as compliance would not impose a disproportionate burden under Annex 4 on the economic operator concerned; the economic operator carries out the corresponding assessment. Two things stand out. First, the limit applies „insoweit“: it does not take the service as a whole out of the requirements, only the part whose compliance would be disproportionate. Second, the assessment is an act of the economic operator. There is no application and no approval; there is an assessment it makes itself and for which it answers under the following subsections.

Annex 4: the three yardsticks

Annex 4 BFSG, which belongs „zu den §§ 17, 21 und 28“, names three criteria „für die Beurteilung und für die Dokumentation der Beurteilung“ – for the assessment and for its documentation. First, the „Verhältnis der Nettokosten, die mit der Einhaltung der Barrierefreiheitsanforderungen verbunden sind, zu den Gesamtkosten (Betriebs- und Investitionsausgaben) für die Herstellung, den Vertrieb oder die Einfuhr des Produkts oder die Erbringung der Dienstleistung“ – the ratio of net compliance costs to total operating and capital costs of producing, distributing or importing the product or providing the service. Second, „die geschätzten Kosten und Vorteile für die Wirtschaftsakteure, einschließlich Produktionsprozessen und Investitionen, im Verhältnis zu dem geschätzten Nutzen für Menschen mit Behinderungen, wobei die Anzahl der Nutzungen und die Nutzungshäufigkeit des betreffenden Produkts oder der betreffenden Dienstleistung zu berücksichtigen sind“ – estimated costs and benefits for the operator against the estimated benefit for persons with disabilities, taking account of the number and frequency of uses. Third, the „Verhältnis der Nettokosten, die mit der Einhaltung der Barrierefreiheitsanforderungen verbunden sind, zum Nettoumsatz des Wirtschaftsakteurs“ – net compliance cost relative to the operator's net turnover.

For the first and third criteria the Annex itemises which net costs are to be included: one-off organisational costs, among them „Kosten für zusätzliches Personal mit Fachkenntnissen im Bereich Barrierefreiheit“ (additional staff with accessibility expertise), „Kosten im Zusammenhang mit der Ausbildung von Personal“ (staff training) and „einmalige Kosten, um sich mit der Rechtslage zur Barrierefreiheit vertraut zu machen“ (one-off costs of familiarisation with the legal position), and running costs, among them „Kosten im Zusammenhang mit der Prüfung des Produkts oder der Dienstleistung unter dem Aspekt der Barrierefreiheit“ (accessibility testing) and „Kosten im Zusammenhang mit der Erstellung der Dokumentation“ (documentation). An assessment that does not put figures on these items assesses nothing within the meaning of the Annex.

Subsection 2: document, keep for five years, produce on request

§ 17(2) BFSG: „Der Wirtschaftsakteur dokumentiert die Beurteilung nach Absatz 1 Satz 2 und bewahrt sie für einen Zeitraum von fünf Jahren ab der letzten Bereitstellung eines Produkts auf dem Markt oder nach der letzten Erbringung einer Dienstleistung auf. Auf Verlangen der Marktüberwachungsbehörde legt er dieser eine Kopie der in Absatz 1 Satz 2 genannten Beurteilung vor. Satz 1 und Satz 2 gelten nicht für Kleinstunternehmen, die mit Produkten befasst sind. Auf Verlangen der Marktüberwachungsbehörde übermitteln Kleinstunternehmen, die mit Produkten befasst sind und die sich auf Absatz 1 Satz 1 berufen, der Behörde jedoch die für die Beurteilung nach Absatz 1 Satz 2 maßgeblichen Fakten.“ In English: the operator documents the assessment and keeps it for five years from the last making available of a product or the last provision of a service; produces a copy to the market surveillance authority on request; sentences 1 and 2 do not apply to micro-enterprises dealing with products, but even they must supply the facts relevant to the assessment on request.

The five-year period does not run from the assessment but „ab der letzten Bereitstellung eines Produkts auf dem Markt oder nach der letzten Erbringung einer Dienstleistung“. For as long as an online shop is operated, it does not end. The relief in sentence 3 applies only to „Kleinstunternehmen, die mit Produkten befasst sind“ – micro-enterprises dealing with products; a micro-enterprise providing a service does not need § 17 at all, because § 3(3) sentence 1 BFSG already exempts it: „Absatz 1 gilt nicht für Kleinstunternehmen, die Dienstleistungen anbieten oder erbringen.“ For every economic operator with ten or more employees, subsection 2 applies in full.

Subsection 3: every five years, and on every change

§ 17(3) BFSG: „Ein Dienstleistungserbringer, der sich auf Absatz 1 Satz 1 beruft, nimmt seine Beurteilung nach Absatz 1 Satz 2 für jede Dienstleistungskategorie oder -art mindestens alle fünf Jahre vor. Die Beurteilung nach Satz 1 hat stets zu erfolgen, wenn 1. die angebotene Dienstleistung verändert wird oder 2. der Dienstleistungserbringer von der für die Prüfung der Konformität der Dienstleistung zuständigen Behörde dazu aufgefordert wird.“ – a service provider relying on subsection 1 carries out the assessment for each service category or type at least every five years, and always when the service offered is changed or when the authority responsible for checking conformity requests it.

The five-year cycle is the upper limit, not the normal case. The normal case is no. 1: the assessment „hat stets zu erfolgen, wenn die angebotene Dienstleistung verändert wird“. A new checkout flow, a new app version, an additional payment method are changes to the service offered. Whoever relies on § 17 therefore carries an assessment duty tied to the release cycle. This is where the exemption can become more expensive than compliance: every assessment has to be documented and kept under subsection 2, and every one has to be notified under subsection 5.

Subsection 4: no exemption with other people's money

§ 17(4) BFSG: „Wenn ein Wirtschaftsakteur zu Zwecken der Verbesserung der Barrierefreiheit nichteigene öffentliche oder private Mittel erhält, ist er nicht dazu berechtigt, sich auf Absatz 1 Satz 1 zu berufen.“ – an operator that receives third-party public or private funds for the purpose of improving accessibility is not entitled to rely on subsection 1 sentence 1. Anyone who has received grants or third-party subsidies for the accessibility of an offering can no longer claim disproportionate burden for that offering. The provision says „öffentliche oder private Mittel“; a subsidy from a group parent is covered just as a public funding programme is.

Subsection 5: the authority hears about it, and without delay

§ 17(5) BFSG: „Wenn sich der Wirtschaftsakteur bei einem bestimmten Produkt oder einer bestimmten Dienstleistung auf Absatz 1 Satz 1 beruft, unterrichtet er darüber unverzüglich die zuständige Marktüberwachungsbehörde oder die für die Überprüfung der Konformität der Dienstleistungen zuständigen Behörde des Mitgliedstaats, in dem das betreffende Produkt in den Verkehr gebracht oder die betreffende Dienstleistung angeboten oder erbracht wird. Satz 1 gilt nicht für Kleinstunternehmen.“ – where the operator relies on subsection 1 sentence 1 for a particular product or service, it informs without delay the competent market surveillance authority, or the authority responsible for checking service conformity, of the Member State where the product is placed on the market or the service is offered or provided; sentence 1 does not apply to micro-enterprises.

Relying on § 17 is therefore not an internal matter. It has to be notified to the market surveillance authority „unverzüglich“ – without delay – and separately for each product and each service. An operator that decides internally on disproportionate burden but does not notify has not met the conditions of § 17. The only group that need not notify is micro-enterprises, and the definition in § 2 no. 17 BFSG is narrow: „weniger als zehn Personen“ and at most 2 million euros in annual turnover or balance sheet total.

Who this binds: the ten-person line

The BFSG has a single size threshold. § 2 no. 17 BFSG defines a micro-enterprise as „ein Unternehmen, das weniger als zehn Personen beschäftigt und das entweder einen Jahresumsatz von höchstens 2 Millionen Euro erzielt oder dessen Jahresbilanzsumme sich auf höchstens 2 Millionen Euro beläuft“. Every relief in the Act – § 3(3) for services, § 17(2) sentence 3 for documentation on products, § 17(5) sentence 2 for notification – hangs on this definition. A company with twenty, fifty or three hundred employees that provides an e-commerce service to consumers under § 1(3) no. 5 BFSG carries § 17 in full: assessment under Annex 4, documentation and retention, repetition on every change, notification to the authority.

In CIVAC the § 17 assessment can be kept as a time-stamped document, the five-year cycle as a recurring task per service type, every change to the service as the trigger for a new task, and the notification to the market surveillance authority as a dated record. It changes nothing about the duty itself. Whether a burden is disproportionate is decided by the assessment under Annex 4; the platform records that it was made, kept and notified.

Frequently asked questions

Can an online retailer with 30 employees rely on disproportionate burden?

Yes, but only with the full procedure of § 17 BFSG: assessment against the Annex 4 criteria, documentation and retention under subsection 2, repetition at least every five years and on every change to the service under subsection 3, immediate notification of the market surveillance authority under subsection 5. The reliefs for micro-enterprises apply under § 2 no. 17 BFSG only below ten employees.

Does the assessment have to be filed anywhere?

The assessment itself does not; under § 17(2) sentence 2 BFSG a copy is produced „auf Verlangen der Marktüberwachungsbehörde“ – on request. What must be notified is the reliance on § 17: under subsection 5 sentence 1 the operator „unterrichtet darüber unverzüglich die zuständige Marktüberwachungsbehörde“.

How long must the assessment be kept?

Under § 17(2) sentence 1 BFSG „für einen Zeitraum von fünf Jahren ab der letzten Bereitstellung eines Produkts auf dem Markt oder nach der letzten Erbringung einer Dienstleistung“ – five years from the last making available of a product or the last provision of a service. For a continuously provided service the period only starts when the service ends.

Does an app update trigger a new assessment?

§ 17(3) sentence 2 no. 1 BFSG requires the assessment „stets“ when „die angebotene Dienstleistung verändert wird“ – whenever the service offered is changed. Whether a particular update is a change to the service offered is a question of the individual case; the wording attaches to the service, not to the size of the change.

Does the exemption still apply if the company received funding for accessibility?

No. § 17(4) BFSG: an operator that „zu Zwecken der Verbesserung der Barrierefreiheit nichteigene öffentliche oder private Mittel erhält, ist … nicht dazu berechtigt, sich auf Absatz 1 Satz 1 zu berufen“.
