
From 20 jobs upwards: the five per cent quota of § 154 SGB IX, the compensatory levy of § 160 and the notice due by 31 March
An employer with an annual monthly average of at least 20 jobs must fill five per cent of them with severely disabled people, pays a tiered compensatory levy for every unfilled mandatory position and reports the figures to the Federal Employment Agency by 31 March. The three provisions verbatim, with the counting rules of § 156 and the fine provisions of § 238.

A duty that starts with the twentieth job
Most appointment duties in German law start high up the headcount scale. The duty to employ severely disabled people does not. § 154(1) sentence 1 SGB IX attaches it to „jahresdurchschnittlich monatlich mindestens 20 Arbeitsplätzen im Sinne des § 156“ – an annual monthly average of at least 20 jobs within the meaning of § 156 – and requires the employer „auf wenigstens 5 Prozent der Arbeitsplätze schwerbehinderte Menschen zu beschäftigen“, to employ severely disabled people in at least 5 per cent of those jobs. A software company with 24 employees, an online retailer with 30, a component supplier with 45: all three are within scope, and all three have something to report every year by 31 March and, in many cases, something to pay.
The rule is built from three parts spread across three sections. § 154 says who has to employ how many people. § 160 says what it costs not to reach that number. § 163 says to whom and by when this has to be reported. §§ 156 and 157 sit alongside them and decide which positions count as jobs at all and how the figures are rounded. § 154(1): five per cent, but a fixed number below 60 jobs
§ 154(1) SGB IX reads in full: „Private und öffentliche Arbeitgeber (Arbeitgeber) mit jahresdurchschnittlich monatlich mindestens 20 Arbeitsplätzen im Sinne des § 156 haben auf wenigstens 5 Prozent der Arbeitsplätze schwerbehinderte Menschen zu beschäftigen. Dabei sind schwerbehinderte Frauen besonders zu berücksichtigen. Abweichend von Satz 1 haben Arbeitgeber mit jahresdurchschnittlich monatlich weniger als 40 Arbeitsplätzen jahresdurchschnittlich je Monat einen schwerbehinderten Menschen, Arbeitgeber mit jahresdurchschnittlich monatlich weniger als 60 Arbeitsplätzen jahresdurchschnittlich je Monat zwei schwerbehinderte Menschen zu beschäftigen.“ In English: employers with at least 20 jobs must employ severely disabled people in at least 5 per cent of them, with particular regard to severely disabled women; by way of derogation, employers with fewer than 40 jobs must employ one severely disabled person and employers with fewer than 60 jobs two, each as an annual monthly average.
Sentence 3 is the part most often overlooked in mid-sized companies. Five per cent of 24 jobs would be 1.2; the statute replaces the arithmetic with a fixed one for employers below 40 jobs and a fixed two for employers below 60. Only from 60 jobs does the percentage apply directly, and then the rounding rule of § 157(2) SGB IX takes over: „Bei der Berechnung sich ergebende Bruchteile von 0,5 und mehr sind aufzurunden, bei Arbeitgebern mit jahresdurchschnittlich weniger als 60 Arbeitsplätzen abzurunden.“ – fractions of 0.5 and above are rounded up; for employers with fewer than 60 jobs they are rounded down. A business with 70 jobs arrives at 3.5 and therefore four mandatory positions; one with 130 jobs at 6.5 and therefore seven.
§§ 156 and 157: which positions count
Whether the threshold of 20 is reached depends on what a job is. § 156(1) SGB IX defines it: „Arbeitsplätze im Sinne dieses Teils sind alle Stellen, auf denen Arbeitnehmerinnen und Arbeitnehmer, Beamtinnen und Beamte, Richterinnen und Richter sowie Auszubildende und andere zu ihrer beruflichen Bildung Eingestellte beschäftigt werden.“ – all positions in which employees, civil servants, judges, trainees and others taken on for vocational training are employed. Subsection 3 removes two groups: „Als Arbeitsplätze gelten ferner nicht Stellen, die nach der Natur der Arbeit oder nach den zwischen den Parteien getroffenen Vereinbarungen nur auf die Dauer von höchstens acht Wochen besetzt sind, sowie Stellen, auf denen Beschäftigte weniger als 18 Stunden wöchentlich beschäftigt werden.“ – positions filled for no more than eight weeks by the nature of the work or by agreement, and positions of fewer than 18 hours a week.
For the count under § 154 a second correction applies. § 157(1) sentence 1 SGB IX: „Bei der Berechnung der Mindestzahl von Arbeitsplätzen und der Zahl der Arbeitsplätze, auf denen schwerbehinderte Menschen zu beschäftigen sind (§ 154), zählen Stellen, auf denen Auszubildende beschäftigt werden, nicht mit.“ – trainee positions do not count towards either the minimum number of jobs or the number of mandatory positions. Trainees are therefore jobs within the meaning of § 156 but are excluded from both the threshold of 20 and the mandatory-position figure. A company with 19 full-time employees and three trainees is below the threshold; one with 19 full-time employees and one part-timer on 20 hours a week is above it. The positions listed in § 156(2), such as dormant employment relationships during parental leave for as long as a replacement is employed, are likewise disregarded.
§ 160(1) and (2): the four tiers of the compensatory levy
§ 160(1) SGB IX makes two things clear: „Solange Arbeitgeber die vorgeschriebene Zahl schwerbehinderter Menschen nicht beschäftigen, entrichten sie für jeden unbesetzten Pflichtarbeitsplatz für schwerbehinderte Menschen eine Ausgleichsabgabe. Die Zahlung der Ausgleichsabgabe hebt die Pflicht zur Beschäftigung schwerbehinderter Menschen nicht auf.“ – for as long as an employer does not employ the prescribed number of severely disabled people, it pays a compensatory levy for every unfilled mandatory position, and paying the levy does not discharge the employment duty. The levy is not a buy-out but a consequence of a duty that continues, and under sentence 3 it is determined „auf der Grundlage einer jahresdurchschnittlichen Beschäftigungsquote“, on the basis of an annual average employment quota.
The amounts are in § 160(2) sentence 1 SGB IX: „Die Ausgleichsabgabe beträgt je unbesetztem Pflichtarbeitsplatz 1. 140 Euro bei einer jahresdurchschnittlichen Beschäftigungsquote von 3 Prozent bis weniger als dem geltenden Pflichtsatz, 2. 245 Euro bei einer jahresdurchschnittlichen Beschäftigungsquote von 2 Prozent bis weniger als 3 Prozent, 3. 360 Euro bei einer jahresdurchschnittlichen Beschäftigungsquote von mehr als 0 Prozent bis weniger als 2 Prozent, 4. 720 Euro bei einer jahresdurchschnittlichen Beschäftigungsquote von 0 Prozent.“ – per unfilled mandatory position 140 euros at a quota of 3 per cent up to the applicable rate, 245 euros at 2 to under 3 per cent, 360 euros at above 0 to under 2 per cent, and 720 euros at 0 per cent. The fourth tier hits the employer with no severely disabled employee at all, and it is twice the third.
For the small employers who under § 154(1) sentence 3 have only one or two mandatory positions, § 160(2) sentence 2 replaces the percentage tiers with headcounts: „für Arbeitgeber mit jahresdurchschnittlich weniger als 40 zu berücksichtigenden Arbeitsplätzen bei einer jahresdurchschnittlichen Beschäftigung von weniger als einem schwerbehinderten Menschen 140 Euro und bei einer jahresdurchschnittlichen Beschäftigung von null schwerbehinderten Menschen 210 Euro“ and „für Arbeitgeber mit jahresdurchschnittlich weniger als 60 zu berücksichtigenden Arbeitsplätzen bei einer jahresdurchschnittlichen Beschäftigung von weniger als zwei schwerbehinderten Menschen 140 Euro, bei einer jahresdurchschnittlichen Beschäftigung von weniger als einem schwerbehinderten Menschen 245 Euro und bei einer jahresdurchschnittlichen Beschäftigung von null schwerbehinderten Menschen 410 Euro“. Below 40 jobs: 140 euros with fewer than one and 210 euros with no severely disabled employee; below 60 jobs: 140, 245 and 410 euros with fewer than two, fewer than one and none. All amounts are per unfilled mandatory position; the quota by which they are measured is, under § 160(1) sentence 3, the annual average.
§ 160(3): why the amounts in the statute are not the amounts on the assessment
Anyone who copies the figures of § 160(2) into a budget is using the wrong ones. § 160(3) sentences 1 and 2 SGB IX: „Die Ausgleichsabgabe erhöht sich entsprechend der Veränderung der Bezugsgröße nach § 18 Absatz 1 des Vierten Buches. Sie erhöht sich zum 1. Januar eines Kalenderjahres, wenn sich die Bezugsgröße seit der letzten Neubestimmung der Beträge der Ausgleichsabgabe um wenigstens 10 Prozent erhöht hat.“ – the levy increases in line with the reference figure of § 18(1) SGB IV, on 1 January of a calendar year once that figure has risen by at least 10 per cent since the amounts were last set. Sentence 5 says where the results are published: „Das Bundesministerium für Arbeit und Soziales gibt den Erhöhungsbetrag und die sich nach Satz 3 ergebenden Beträge der Ausgleichsabgabe im Bundesanzeiger bekannt.“
The footnote to § 160 on gesetze-im-internet.de points, for the period from 1 January 2025, to the notice of 2 December 2024 (BAnz AT 11.12.2024 B2). The amounts published there are the ones the Integration Office collects for the calendar year 2025; they are higher than the statute's figures and, under sentence 4, „auf den nächsten durch fünf teilbaren Betrag abzurunden“ – rounded down to the nearest amount divisible by five. § 160(4) and § 163(2): 31 March and 30 June
Both duties hang on a date. § 163(2) sentence 1 SGB IX: „Die Arbeitgeber haben der für ihren Sitz zuständigen Agentur für Arbeit einmal jährlich bis spätestens zum 31. März für das vorangegangene Kalenderjahr, aufgegliedert nach Monaten, die Daten anzuzeigen, die zur Berechnung des Umfangs der Beschäftigungspflicht, zur Überwachung ihrer Erfüllung und der Ausgleichsabgabe notwendig sind.“ – employers report to the Employment Agency responsible for their seat, once a year by 31 March at the latest and broken down by month, the data needed to calculate the scope of the employment duty, to monitor compliance and to determine the levy. Sentence 2 requires the register kept under subsection 1 to be attached; sentence 3 requires a copy each to the works council, the representative body for severely disabled employees and the employer's inclusion officer.
§ 160(4) sentence 1 SGB IX ties payment to the same day: „Die Ausgleichsabgabe zahlt der Arbeitgeber jährlich zugleich mit der Erstattung der Anzeige nach § 163 Absatz 2 an das für seinen Sitz zuständige Integrationsamt.“ – the employer pays the levy annually, together with the notice, to the Integration Office responsible for its seat. Under sentence 3 the Integration Office charges „für rückständige Beträge der Ausgleichsabgabe … nach dem 31. März Säumniszuschläge nach Maßgabe des § 24 Absatz 1 des Vierten Buches“ – late-payment surcharges after 31 March – and under sentence 2 issues a determination notice once the employer is more than three months in arrears. On the reporting side § 163(3) sets a second date: „Zeigt ein Arbeitgeber die Daten bis zum 30. Juni nicht, nicht richtig oder nicht vollständig an, erlässt die Bundesagentur für Arbeit nach Prüfung in tatsächlicher sowie in rechtlicher Hinsicht einen Feststellungsbescheid über die zur Berechnung der Zahl der Pflichtarbeitsplätze für schwerbehinderte Menschen und der besetzten Arbeitsplätze notwendigen Daten.“ – if the data have not been reported, or not correctly or completely, by 30 June, the Federal Employment Agency determines them itself.
§ 238: what a missed notice costs
The levy is not a penalty; it is the consequence of an unmet quota. What is penalised is the procedure around it. § 238(1) SGB IX lists, at no. 2, anyone who „entgegen § 163 Absatz 1 ein Verzeichnis nicht, nicht richtig, nicht vollständig oder nicht in der vorgeschriebenen Weise führt oder nicht oder nicht rechtzeitig vorlegt“ – fails to keep or produce the register correctly, completely, in the prescribed form or on time; at no. 3, anyone who „entgegen § 163 Absatz 2 Satz 1 oder Absatz 4 eine Anzeige nicht, nicht richtig, nicht vollständig, nicht in der vorgeschriebenen Weise oder nicht rechtzeitig erstattet“ – fails to file the notice correctly, completely, in the prescribed form or on time; and at no. 6, anyone who „entgegen § 163 Absatz 8 eine dort bezeichnete Person nicht oder nicht rechtzeitig benennt“ – fails to name the inclusion officer or representative body on time. § 238(2): „Die Ordnungswidrigkeit kann mit einer Geldbuße bis zu zehntausend Euro geahndet werden.“ – a fine of up to ten thousand euros. The competent authority under subsection 3 is the Federal Employment Agency.
What an employer with 20 or more jobs has to keep every year
The provisions produce an annual calendar with four entries. First, the register under § 163(1), „gesondert für jeden Betrieb und jede Dienststelle“ – separately for each establishment – and „laufend zu führen“, kept continuously. Second, the monthly count of jobs under §§ 156 and 157, because § 154 works on the annual average of monthly figures, not on a single reference date. Third, the notice by 31 March under § 163(2), on the Federal Employment Agency forms that subsection 6 prescribes. Fourth, payment of the levy on the same day under § 160(4), in the amount of the current notice under § 160(3).

Does the employment duty apply from 20 employees or from 20 full-time positions?
From 20 jobs within the meaning of § 156 SGB IX, as an annual monthly average. A part-time position counts as a job once it reaches 18 hours a week; § 156(3) excludes only positions „mit weniger als 18 Stunden wöchentlich“ and positions lasting no more than eight weeks. Trainees are left out of the calculation by § 157(1) sentence 1.
How many severely disabled people must a company with 35 jobs employ?
One. § 154(1) sentence 3 SGB IX replaces the percentage with a fixed one for employers „mit jahresdurchschnittlich monatlich weniger als 40 Arbeitsplätzen“. From 40 to below 60 jobs it is two; from 60 the percentage applies with the rounding rule of § 157(2).
How high is the levy if no severely disabled person is employed at all?
In the statute text § 160(2) sentence 1 no. 4 SGB IX gives 720 euros per unfilled mandatory position at a quota of 0 per cent; for employers below 40 jobs sentence 2 no. 1 gives 210 euros, below 60 jobs sentence 2 no. 2 gives 410 euros. The amount actually owed is the figure indexed under § 160(3) and published in the current Bundesanzeiger notice, for 2025 the notice of 2 December 2024.
What happens if the 31 March notice is not filed?
Two things. Under § 163(3) SGB IX the Federal Employment Agency issues a determination notice if the data have not been reported correctly and completely by 30 June. And under § 238(1) no. 3 in conjunction with § 238(2) SGB IX a late or missing notice can be fined as an administrative offence with up to ten thousand euros. The levy itself is unaffected; it falls due on 31 March under § 160(4), and late-payment surcharges accrue thereafter.
Does paying the levy release the employer from the employment duty?
No. § 160(1) sentence 2 SGB IX says so expressly: „Die Zahlung der Ausgleichsabgabe hebt die Pflicht zur Beschäftigung schwerbehinderter Menschen nicht auf.“ – paying the levy does not lift the duty to employ severely disabled people.
