What does a Waste Disposal Officer do?

A Waste Disposal Officer keeps the disposal chain for hazardous and non-hazardous waste traceable from the point of generation to final treatment. The role is anchored in the Closed Substance Cycle Waste Management Act (Kreislaufwirtschaftsgesetz, KrWG) and the Verification Ordinance (Nachweisverordnung, NachwV), which require documented proof that each waste stream reached a permitted facility. For hazardous waste the officer manages the electronic verification procedure (elektronisches Abfallnachweisverfahren, eANV) under NachwV, including responsible declarations, declaration analyses and collective and single verification records.

The officer maintains the waste register (Register) demanded by Sec. 49 KrWG and NachwV, retaining accepted and delivered consignment notes (Begleitscheine) for the statutory period. They verify that contracted disposal companies hold a valid certification as a specialised waste management company (Entsorgungsfachbetrieb) under the Entsorgungsfachbetriebeverordnung (EfbV), so that the chain of custody is documented end to end. Where the company itself accepts or treats waste, the officer ensures permits under the Federal Immission Control Act (BImSchG) are respected.

Beyond paperwork the officer advises management on waste avoidance and the five-step waste hierarchy of Sec. 6 KrWG, classifies waste using the European Waste Catalogue codes (Abfallverzeichnis-Verordnung, AVV) and supports compliance with extended producer responsibility regimes such as the Packaging Act (VerpackG) and the Battery Act (BattG). The aim is a defensible, audit-ready record that satisfies the supervisory authority at any time.

Core duties of the Waste Disposal Officer

  • Operate the electronic verification procedure (eANV) for hazardous waste and issue responsible declarations under NachwV.
  • Maintain the waste register and retain consignment notes (Begleitscheine) for the retention periods set by Sec. 49 KrWG and NachwV.
  • Classify every waste stream with the correct six-digit code under the European Waste Catalogue (AVV).
  • Verify that disposal contractors hold a current Entsorgungsfachbetrieb certificate under the EfbV before consignments are released.
  • Confirm that downstream facilities hold the required BImSchG permit for the waste type delivered.
  • Apply the waste hierarchy of Sec. 6 KrWG and advise on avoidance, reuse and recycling before disposal.
  • Track producer-responsibility obligations under the Packaging Act (VerpackG) and Battery Act (BattG).
  • Prepare records and consignment data for inspections by the lower waste authority and submit annual notifications where required.
  • Document declaration analyses and acceptance checks so the chain of custody is complete from acceptance to final treatment.
  • Brief operational staff on correct collection, labelling and storage of hazardous waste.

When is a Waste Disposal Officer required?

A formal company Waste Officer (Abfallbeauftragter) must be appointed under Sec. 59 KrWG in conjunction with the Ordinance on Waste Officers (Abfallbeauftragtenverordnung, AbfBeauftrV) by operators of certain installations, in particular installations requiring a permit under the BImSchG, landfills, and facilities that store or treat hazardous waste above the thresholds named in the ordinance. The competent authority can also order an appointment in individual cases under Sec. 59 (2) KrWG.

The appointment must be in writing and the officer must be reliable and technically qualified (fachkundig) as required by Sec. 60 KrWG; many operators evidence this through recognised training. Even where no statutory appointment threshold is met, every waste producer remains subject to the register and verification duties of the NachwV, so larger sites routinely name a responsible person voluntarily to manage the eANV and EfbV checks. The officer reports to management, must be granted the resources to perform the role, and enjoys protection against disadvantage for fulfilling the duties.
