ADR certificate online: What works digitally, what doesn't and who is liable

The ADR certificate cannot be purchased entirely online. This article clarifies which parts of the training are permitted digitally, which IHK examination requires attendance and how you as a company can organise the evidence in an audit-proof manner.

According to Section 5 Paragraph 1 of the Dangerous Goods Driver Training Ordinance (GbV) in conjunction with Section 8.2.2 ADR, ADR training in Germany is tied to an officially recognised course. The responsible Chamber of Commerce and Industry checks the content, issues the ADR certificate and controls the training providers. The desire to acquire the ADR certificate completely online fails due to a simple requirement: the final examination is an in-person examination in front of the IHK. Practical exercises, such as how to use protective equipment or fight fires, cannot be transferred to the browser for legal reasons. Anyone in a human resources department who wants to employ three new drivers at short notice is therefore not confronted with a platform question, but rather with a logistics question.

Nevertheless, the question is justified, because a significant part of the theory is now permissible digitally. Distance lessons are only permitted from a training provider recognised in accordance with Section 4 GbV. Pure self-study courses or unaccompanied learning videos on YouTube or similar platforms do not meet the requirements and do not lead to admission to the exam. International online courses that are offered in other ADR countries are also not easily recognised in Germany. The decisive factor is German recognition in the chamber district of the training location or the participant.

Specifically, the online component must meet several requirements: synchronous learning units with a live lecturer via video conference, clear identification of the participants via photo ID at the start of the training, regular interaction phases instead of frontal foil, a technical solution for checking attendance and verifiable documentation of the learning times per participant. The usual split is around 50 percent presence, 50 percent distance, with the practical exercises and the exam preparation day taking place in person. Process of a modern ADR training course with an online component

A typical basic course with an online component begins with a kick-off face-to-face session in which participants present their photo IDs, receive access data to the learning platform and go through the organisational rules. This is followed by several synchronous online days in which the legal basis of ADR, the classification of dangerous goods, packaging regulations, load securing, labelling and documentation are discussed. Between the live units, the participants work on exercises that are evaluated and discussed. The learning curve is high because the ADR table A of the list of substances, the UN numbers and the special regulations are not internalized by simply listening, but only through active practice.

The last days will take place in person again. The focus here is on practical content: behaviour at the scene of an accident, first aid, fighting fires with real fire extinguishers, wearing and adjusting personal protective equipment as well as emergency exercises with an escape mask and eyewash bottle. The written IHK exam takes place immediately after the course ends. Depending on the class, it includes 30 to 45 questions in multiple-choice and free-text format, is limited to 60 to 90 minutes and requires at least 80 percent correct answers. Failure is possible, but repeating is usually permitted within twelve months. Passing is documented in the certificate with a five-year validity, in credit card format, issued by the IHK. An advanced tank course costs an additional 200 to 350 euros, the advanced courses class 1 or class 7 each cost 150 to 300 euros. The IHK examination fee is between 50 and 120 euros for each variant. Refresher training to extend the certificate costs between 200 and 400 euros per class combination and must be successfully completed before the end of the five years. There are also indirect costs: driver downtime, travel costs for the attendance phase, accommodation and meals if necessary, as well as internal preparation.

The right choice of class size is economically crucial. Anyone who only drives packaged materials in classes 3, 6.1 or 8 only needs the basic course. Tank trips require the advanced tank course. Transporting explosives, for example for the construction industry, requires the Class 1 advanced course. Radioactive substances, for example in nuclear medicine or industrial x-rays, are not permitted without a Class 7 advanced course. A company should document the class combinations of its drivers and compare them with the vehicle pool and real transports. An ADR certificate must also be checked: Anyone who does not have the correct class is legally driving without a licence, with all the consequences for the driver and owner. What is sometimes overlooked is that refreshers have to be carried out separately for each class; a single refresher day does not automatically cover the base and tank at the same time. Proper personnel planning therefore includes a training budget for each driver and year. Liability situation for employers and dangerous goods representatives

The commissioning of a driver who is not or not sufficiently qualified is an administrative offense according to Section 37 GGVSEB and can be punished with fines of up to several thousand euros per violation. In the event of repeated violations or an accident involving dangerous goods, Section 130 OWiG may also apply: breach of supervisory duty by management, with fines of up to 1 million euros in the group context. In criminal law, Sections 315b and 315c of the Criminal Code also become relevant in cases of negligent endangerment of road traffic. In the event of damage, a missing or expired certificate is usually the first point that the insurance company and the public prosecutor's office check. In addition, there is civil liability towards third parties, for example in the event of contamination of a road or body of water.

Operationally, responsibility lies with the Dangerous Goods Officer in accordance with Section 1 GbV. Depending on the activity, there is also a certificate of suitability and proof of the driving licence class. In the case of materials or metabolism in the fleet, instructions should be documented, because in the event of damage, the supervisory authority checks whether the specific substance was covered.

Anyone who is involved in the transport without being a vehicle driver, such as dispatchers, loaders, packers, fillers, shippers, falls under the so-called 1.3 instruction according to Section 1.3 ADR. This instruction is activity-related, must take place before starting the activity and be repeated at regular intervals. It can also take place entirely or partially online, but must be organised and documented by the employer. The obligation to provide documentation lies with the employer, not with the training provider. An annual instruction cycle with short refreshers on metabolism or new packaging has proven to be useful in practice.

Anyone who is appointed as a safety consultant in accordance with Section 1.8.3 ADR undergoes a different qualification: the IHK safety consultant examination, which again mainly takes place in person and is extended every five years. The safety advisor is not necessarily the same as the dangerous goods officer, but in many companies the role is combined. If a company uses subcontractors, it remains jointly responsible for compliance with the regulations according to Section 1.4 ADR. Contracts should therefore regulate the presentation of the ADR certificates of the drivers deployed and provide for the client's audit rights. Common mistakes when searching for the ADR certificate online

If you search for an ADR certificate online, you will come across a wide range of offers. Not all of them are serious. A first filter is to check the IHK recognition of the organizer: This information can be checked with the responsible IHK by telephone or via their website. A second warning signal are offers that promise an ADR certificate without an IHK examination or without practical exercises. Such certificates are not valid in Germany. Thirdly, it is worth taking a look at the duration of the course: If an offer falls significantly short of the ADR minimum number of hours, it is either illegal or contains hidden days of attendance. Fourthly, the class bundle offered must be checked, because not every provider regularly runs advanced courses for class 1 or class 7.

ADR certificates issued abroad are also a special case. According to Section 8.2.2.10 ADR, they are generally mutually recognised provided they were issued in the EU or ADR contract area, are multilingual (at least English, French or German) and contain all mandatory information. In practice, before the first use, it is worth having the dangerous goods officer check whether the class content corresponds to the transports carried out here. A blanket takeover without checking is risky. With each extension cycle, the question arises as to whether the certificate should be refreshed in Germany, which stabilizes the basis for recognition.
