How it runs

   Facilities, containment levels and current state

   We record which genetic engineering facilities exist, which containment level the work falls under per Section 7 Para. 1 GenTG, and whether they are notified, registered or licensed under Section 8 GenTG. That determines which duties the appointment has to describe precisely under Section 29 Para. 1 sentence 3 GenTSV. Assigning a piece of work to a containment level is a call your house makes with the project leader; we supply the inventory and the open points.

   Application for permission under Section 29 Para. 2 GenTSV

   The application comes before the appointment. Section 29 Para. 2 GenTSV ties the permission to the external appointment ensuring that the duties in Section 31 GenTSV are properly discharged, so the application consists of the qualification evidence under Section 30 GenTSV, the scope of duties, the availability arrangement and the planned inspection cadence. You file it, we assemble it. The competent authority decides at its discretion; there is no entitlement to the permission and this service claims none.

   Hearing and written appointment

   Section 29 Para. 1 sentence 1 GenTSV places the works or staff council hearing before the appointment, and the appointment itself must be in writing. Sentence 3 requires the duties of each individual officer to be described precisely, which carries more weight for an external appointment than an internal one: what is not in the appointment letter has not been delegated. You receive the appointment letter, the description of duties and the deputy arrangement in a form you can hand to the authority or attach to an audit.

   Ongoing operation

   Regular inspection of the facility under Section 31 Para. 1 no. 1 GenTSV runs at the agreed cadence, defects go to the operator and the project leader, and their removal is verified and recorded. Advice under Section 31 Para. 1 no. 2 GenTSV runs alongside as occasions arise, in particular the opinion before procuring safety-relevant equipment, which Section 32 Para. 4 GenTSV requires early enough to still bear on the decision. Where no agreement with the project leader is reached, Section 32 Para. 5 GenTSV opens the route directly to the deciding body.

   Annual report and evidence

   Section 31 Para. 2 GenTSV requires an annual written report to the operator on the measures taken and intended. It is delivered as a document, not as a meeting note, and it follows on from the continuous record in the workspace. When facilities, containment levels or the work itself change, the scope of the appointment is updated and we check whether the permission under Section 29 Para. 2 GenTSV still covers the new scope.

The legal frame

The provisions below determine who has to appoint a Biological Safety Officer, on what condition that person may come from outside, what they owe and what a missing appointment costs. Each is quoted in the original German wording so you can hold it against the ordinance.

Section 29 Para. 1 sentence 1 and Para. 2 GenTSV

Der Betreiber hat nach Anhörung des Betriebs- oder Personalrats einen oder, wenn dies im Hinblick auf die Art oder den Umfang der gentechnischen Arbeiten oder der Freisetzungen zum Schutz für die in § 1 Nummer 1 des Gentechnikgesetzes genannten Rechtsgüter erforderlich ist, mehrere Beauftragte für die Biologische Sicherheit schriftlich zu bestellen. Die zuständige Behörde kann dem Betreiber auf Antrag die Bestellung eines nicht betriebsangehörigen Beauftragten oder mehrerer nicht betriebsangehöriger Beauftragter für die Biologische Sicherheit gestatten, wenn hierdurch die sachgerechte Erfüllung der in § 31 bezeichneten Aufgaben sichergestellt ist.

Para. 1 creates the duty and prescribes written form. Para. 2 is the legal basis for this service, but it is weaker than its counterparts in the HinSchG and the LkSG: there the company decides for itself, here the authority decides on application and at its discretion. The sequence is application, permission, appointment. An external appointment made without the permission does not discharge the duty in Para. 1 sentence 1.

Section 30 GenTSV

Zum Beauftragten für die Biologische Sicherheit darf nur eine Person bestellt werden, die die erforderliche Sachkunde besitzt. Die Anforderungen an die erforderliche Sachkunde und an deren Nachweis richten sich nach der für den Projektleiter geltenden Vorschrift des § 28.

The qualification is not a category of its own; it is the project leader's. Through Section 28 Para. 2 sentence 1 GenTSV that means a completed degree in natural sciences, medicine or veterinary medicine at master, Diplom or Staatsexamen level, or a doctorate in those fields, at least three years of work in genetic engineering, and a certificate of attendance at a training event recognised by the competent state authority. Under Section 28 Para. 3 sentence 1 GenTSV that knowledge must be refreshed at least every five years. For containment level 3 or 4 work, Section 28 Para. 2 sentence 1 no. 2 GenTSV adds at least two years of work at containment level 2, 3 or 4.

Section 31 Para. 1 no. 1 and Para. 2 GenTSV

Der Beauftragte für die Biologische Sicherheit ist berechtigt und verpflichtet, die Erfüllung der auf die Sicherheit gentechnischer Arbeiten oder der Freisetzungen bezogenen Aufgaben des Projektleiters zu überwachen, insbesondere durch regelmäßige Kontrolle der gentechnischen Anlage oder der Freisetzungsorte, durch Mitteilung festgestellter Mängel an den Betreiber und an den Projektleiter und durch Überprüfung der Beseitigung dieser Mängel. Der Beauftragte für die Biologische Sicherheit erstattet dem Betreiber jährlich einen schriftlichen Bericht über die nach Absatz 1 getroffenen und beabsichtigten Maßnahmen.

The role is monitoring and advice, not execution. The officer monitors the project leader's duties, which is why the two appointments are kept apart and why an external appointment relieves the monitoring structurally: it does not sit in the reporting line of the area being monitored. The annual report under Para. 2 is owed by the officer and must be in writing.

Section 33 no. 12 GenTSV in conjunction with Section 38 Para. 1 no. 12 and Para. 2 GenTG

Ordnungswidrig im Sinne des § 38 Absatz 1 Nummer 12 des Gentechnikgesetzes handelt, wer vorsätzlich oder fahrlässig entgegen § 29 Absatz 1 Satz 1 einen Beauftragten für die Biologische Sicherheit nicht oder nicht rechtzeitig bestellt. Die Ordnungswidrigkeit kann mit einer Geldbuße bis zu fünfzigtausend Euro geahndet werden.

A missing or late appointment carries an administrative fine expressly, and negligence is enough. The amount is not in the GenTSV: Section 33 GenTSV points to Section 38 Para. 1 no. 12 GenTG, and only Section 38 Para. 2 GenTG names the figure of fifty thousand euros. The offence attaches to the appointment itself, not to the quality of performance; appointing late already completes it.

Older sources, model appointment letters and consultancy material frequently still cite Sections 16 and 18 GenTSV for the appointment; that numbering is superseded. Since the recast, appointment, qualification, duties and operator obligations sit in Sections 29 to 32 GenTSV.

How the price is built

The price has four components, shown separately. The first is unusual for this service and is therefore named on its own: before the appointment there is an administrative procedure whose outcome nobody can promise.

• The number of genetic engineering facilities and sites covered by the appointment.
• The containment level of the work under Section 7 Para. 1 GenTG, because it drives both the inspection cadence and, through Section 28 Para. 2 sentence 1 no. 2 GenTSV, the qualification requirement.
• Whether Section 29 Para. 1 sentence 2 GenTSV calls for several officers and therefore a committee for biological safety.
• The number of on-site inspections and the distance to the site.
• Whether the employee information material under Section 21 Para. 1 GenTSV is taken alongside the appointment.

Common questions

Can the Biological Safety Officer come from outside the company?

Yes, but only with prior permission. Section 29 Para. 2 GenTSV reads: Die zuständige Behörde kann dem Betreiber auf Antrag die Bestellung eines nicht betriebsangehörigen Beauftragten oder mehrerer nicht betriebsangehöriger Beauftragter für die Biologische Sicherheit gestatten, wenn hierdurch die sachgerechte Erfüllung der in § 31 bezeichneten Aufgaben sichergestellt ist. That sets this appointment apart from other outsourcing in German officer law. Section 14 Para. 1 HinSchG and Section 8 Para. 1 sentence 6 LkSG let the company choose the external route itself; here the authority decides, and it decides at its discretion. The sequence is therefore application, permission, appointment. An external appointment without the permission does not discharge the duty in Section 29 Para. 1 sentence 1 GenTSV.

How does the officer differ from the project leader?

In the task and in the direction. The project leader is responsible under Section 27 GenTSV for carrying out the genetic engineering work. The Biological Safety Officer is entitled and obliged under Section 31 Para. 1 no. 1 GenTSV to monitor the safety-related duties of the project leader, in particular through regular inspection of the facility, notification of defects to the operator and the project leader, and verification that those defects have been remedied. One appointment executes, the other monitors. That is why there are two appointments with two appointment letters, and why Section 32 Para. 5 GenTSV expressly provides that the officer may put concerns directly to the deciding body where no agreement with the project leader could be reached.

What qualification must the officer hold?

The same as a project leader. Section 30 sentence 2 GenTSV points to Section 28 GenTSV for this. Under Section 28 Para. 2 sentence 1 GenTSV that means a completed degree in natural sciences, medicine or veterinary medicine at master, Diplom or Staatsexamen level, or a doctorate in those fields; at least three years of work in the field of genetic engineering, in particular microbiology, cell biology, virology or molecular biology; and a certificate of attendance at a training event recognised by the competent state authority. For containment level 3 or 4 work, Section 28 Para. 2 sentence 1 no. 2 GenTSV adds at least two years of work at containment level 2, 3 or 4. Under Section 28 Para. 3 sentence 1 GenTSV the training knowledge must be refreshed at least every five years, and the refresher must be evidenced to the competent authority.

What size of company does the duty apply to?

The GenTSV has no headcount or turnover threshold. It attaches to the activity. Anyone who is an operator within the meaning of Section 3 no. 7 GenTG, that is, who under their own name builds or runs a genetic engineering facility or carries out genetic engineering work, falls under Section 29 Para. 1 sentence 1 GenTSV. A genetic engineering facility is defined in Section 3 no. 4 GenTG as an installation in which genetic engineering work is carried out in a closed system with specific containment measures applied. In practice a small laboratory that has notified a containment level 1 facility under Section 8 Para. 2 GenTG carries the same appointment duty as a corporate site. Whether several officers are needed follows from the nature and extent of the work under Section 29 Para. 1 sentence 1 GenTSV, not from the size of the business.

What does a missing appointment cost?

Up to fifty thousand euros, and the figure is not where most people look for it. Section 33 no. 12 GenTSV provides that a person acts unlawfully within the meaning of Section 38 Para. 1 no. 12 GenTG who, intentionally or negligently, fails to appoint a Biological Safety Officer, or fails to appoint one in time, contrary to Section 29 Para. 1 sentence 1. The GenTSV itself names no amount; only Section 38 Para. 2 GenTG states that the offence may be punished by an administrative fine of up to fifty thousand euros. Two details are regularly missed: negligence is enough, and a late appointment already completes the offence.

Does the appointment also discharge duties under the BioStoffV and the GefStoffV?

No, and the question is worth separating cleanly. The appointment under Section 29 GenTSV is a duty of German genetic engineering law and covers the tasks that Section 31 GenTSV sets out. The Biological Agents Ordinance and the Hazardous Substances Ordinance have their own scope and their own duties, and neither creates an appointed officer that could be filled alongside. Where an activity falls under more than one body of rules, they remain separate duties with separate evidence. A page that merges them into one role reads more easily and leaves the file in worse shape.

What does the service cost at CIVAC?

The price has four components: the one-off set-up including the documentation for the permission application under Section 29 Para. 2 GenTSV, an ongoing retainer for the appointed officer and the deputy, on-site inspections per visit, and the optional employee information material and additional facilities. The figure depends on the number of facilities and sites, on the containment level of the work under Section 7 Para. 1 GenTG, on whether Section 29 Para. 1 sentence 2 GenTSV calls for several officers and therefore a committee for biological safety, and on the number of inspections.
